Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DaysWithout app, the dayswithout.life website, and all related services (collectively, the "Service"). By creating an account or using the Service, you confirm you have read, understood and accept these Terms and the Privacy Policy.

1. Acceptance

By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms constitute a binding contract between you and Hessel IT Solutions (the "Company", "we").

2. Service description

DaysWithout is a behavioral tracking app for people recovering from compulsive habits (alcohol, nicotine, digital behaviors, and others). The Service includes:

  • Habit counters and relapse logging
  • Daily journal with mood↔text correlation
  • Themed community (Tribes) and Support Allies
  • AI Companion (Atlas / Mira) grounded in behavioral science
  • SOS button, clinical breathing, automated crisis detection

3. Medical notice

⚠️ Important — read carefully.

DaysWithout is NOT a medical, psychological, or emergency service. It does not replace clinical care, psychotherapy, prescribed medication, or any form of professional mental health or addiction treatment.

The AI Companion (Atlas / Mira) is a behavioral-science-based support tool. It does not diagnose, prescribe, or replace a therapist.

In case of active crisis, suicidal ideation, or emergency:

  • UK: Samaritans 116 123 · 999 emergency
  • EU: Local crisis hotlines or 112
  • Brazil: CVV 188 · SAMU 192

For habits involving physical dependence (e.g., chronic alcohol use), stopping abruptly can cause serious complications (delirium tremens, seizures). Seek medical guidance before beginning abstinence.

4. User account

To use the Service you must create an account. By creating an account, you confirm that:

  • You are at least 18 years old
  • The information provided is accurate and up to date
  • You will maintain the confidentiality of your credentials
  • You are responsible for all activity under your account

We reserve the right to suspend or delete accounts that violate these Terms.

5. User content

You retain full ownership of the content you create on the app — journal, Tribe posts, private messages, counters. You grant us a limited, non-exclusive, royalty-free license to:

  • Store and process your content to provide the Service
  • Apply automated and human moderation on public content (Tribes)
  • Analyze in aggregate for product improvements (no individual identification)

Private content (journal, ally messages) is never published or shared outside the scope you define.

6. Prohibited conduct

You may not use the Service to:

  • Publish illegal, violent, sexually explicit, or abusive content
  • Harass, threaten, or offend other users
  • Glorify self-destructive behavior or encourage relapse in others
  • Impersonate others or create multiple accounts with fraudulent intent
  • Attempt to compromise the security, integrity, or availability of the Service
  • Scrape data without written authorization
  • Use the Service for unauthorized advertising or spam

Violations may result in immediate suspension, account deletion, and/or reports to competent authorities.

7. Plans and payments

7.1 Free plan

The DaysWithout app has a permanent free plan including: counters (up to 3), unlimited journal, community, SOS button, clinical breathing, 3 chats/week with the AI Companion, up to 3 allies, 1 theme.

7.2 Pro plan

The Pro plan adds unlimited counters, unlimited AI Companion chats, advanced behavioral insights, unlimited allies, 6 premium themes, and counter editing with analytics. Current prices:

  • Pro Monthly: €6.99 / month
  • Pro Annual: €59.99 / year (saves ~28%)

Prices may vary by region (EUR, USD, BRL) and may be updated with 30 days' notice.

7.3 15-day trial

New users receive 15 days of free Pro access upon account creation, with no credit card required. At the end of the trial, you automatically return to the free plan — no automatic charges. To continue Pro, you manually choose a paid plan.

7.4 Payments and renewal

Payments are processed by Stripe Inc. Subscriptions auto-renew at the end of each period (monthly or annual). You can cancel renewal at any time in Settings → Manage Subscription; Pro access remains until the end of the paid period.

7.5 Refunds

Paid subscriptions are refundable within 14 days of first purchase (in compliance with EU right of withdrawal / BR consumer code), provided usage is under 25% of the period. Auto-renewals are not refundable after the new period begins. Refunds: contact contato@hesselitsolutions.com.

8. Intellectual property

The Service, including software, design, "DaysWithout" trademark, logos, and editorial content (psychoeducation, tips, AI Companion text), is owned by the Company and protected by copyright, trademark, and other applicable laws.

We grant you a personal, limited, non-transferable, revocable license to use the Service per these Terms. You may not reproduce, distribute, modify, create derivative works, or commercially exploit the Service without written authorization.

9. Limitation of liability

To the maximum extent permitted by law:

  • The Service is provided "as is", without express or implied warranties of fitness for a particular purpose
  • We do not guarantee uninterrupted availability, error-free operation, or that the Service will meet specific health or recovery expectations
  • We are not liable for clinical, medical, or personal decisions made based on information provided by the app
  • Our total liability, in any case, is limited to the amount paid by the user in the last 12 months

This limitation does not apply to damages resulting from our willful misconduct or gross negligence, nor does it affect non-waivable consumer rights under LGPD/GDPR/CDC.

10. Disclaimers

  • No medical advice: no Service content constitutes medical, psychological, or pharmacological advice
  • AI Companion: AI-generated responses may contain inaccuracies. Always verify with a qualified professional
  • Community: content generated by other users in Tribes does not reflect the Company's views
  • No promises of outcome: recovery is individual; we do not guarantee specific abstinence or wellbeing results

11. Changes to service and terms

We may modify, add, or remove Service features at any time. Material changes to these Terms will be communicated at least 30 days in advance via email and/or in-app notification.

Continued use after the effective date constitutes acceptance. If you disagree, you can delete your account before the effective date.

12. Termination

You can delete your account at any time in Settings → Account. You have the same right to keep or delete data upon cancellation — see Privacy Policy.

We reserve the right to suspend or delete accounts that violate these Terms, with prior notice except in cases of immediate risk.

13. Governing law and venue

These Terms are governed by the laws in force where you reside:

  • Brazil: Consumer Defense Code (CDC), LGPD, Civil Code. Venue: consumer's domicile.
  • European Union / Portugal: GDPR, Consumer Protection Law. Venue: consumer's domicile, without prejudice to EU online dispute resolution (ODR).
  • Other countries: Applicable local consumer-protection law; consumer's domicile venue.

Disputes should first be attempted amicably via contato@hesselitsolutions.com before any judicial action.
